Terms of Service

These terms explain the rules and responsibilities that apply when you use DAYFACTOR. They are written to be understandable and should be read together with the Privacy Policy.

1. Acceptance

By downloading, accessing or using DAYFACTOR, you agree to these Terms of Service and the applicable Apple terms. If you do not agree, do not use the app. DAYFACTOR is provided by Ibrahim Khalaf, operating DAYFACTOR, Sweden.

2. Eligibility

You must be legally able to enter into these terms in your country. DAYFACTOR is intended for adults and is not directed to children under 13. A higher minimum age applies where required by law.

3. Wellness purpose and no medical advice

DAYFACTOR is a general wellness and self-organization tool. It may help you record habits, meals, focus, calm sessions, reminders and progress. It is not a medical device and does not diagnose, treat, cure or prevent any condition. Information and insights in the app are not medical, nutritional or emergency advice.

You remain responsible for your health decisions. Consult a qualified professional about medical concerns, major dietary or activity changes, or symptoms. In an emergency, contact local emergency services.

4. Your responsibility

You are responsible for the accuracy of information you enter, your device security and how you interpret general wellness information. Goals, calculations and patterns may contain errors or may not suit your circumstances. Use reasonable judgment and do not rely on DAYFACTOR as your only source for decisions involving health, safety, finances or legal matters.

5. Local data and recovery limits

DAYFACTOR V1 stores wellness data locally and does not provide a DAYFACTOR account, cloud backup, cross-device synchronization or account-based recovery. Deleting the app or losing, resetting or damaging the device may permanently remove local data when no applicable device backup can restore it. You are responsible for the device backup settings you choose. DAYFACTOR cannot guarantee backup or recovery.

6. Apple Health

Supported Apple Health access requires your permission. You can grant, refuse or later change that access in Apple Health or iOS settings. Availability depends on your device, iOS version, region and the categories supported by DAYFACTOR. Apple Health information remains subject to Apple's platform rules.

7. DAYFACTOR+ subscriptions

DAYFACTOR is free to start. DAYFACTOR+ is an optional auto-renewing subscription that may provide deeper insights and additional premium functionality. Monthly and annual billing options are planned. The App Store purchase screen shows the actual localized price, billing period and included features before you confirm a purchase.

Trials and renewal

Where Apple displays it as available and you are eligible, an annual subscription may include a one-week introductory trial. Eligibility is determined through Apple. Unless cancelled at least as required by Apple before the current period ends, a subscription renews automatically and Apple charges the payment method associated with your Apple ID.

Cancellation, restoration and refunds

Manage or cancel through your Apple subscription settings; deleting DAYFACTOR does not automatically cancel a subscription. Restore Purchases is available from Profile and the purchase sheet. Refund requests are handled by Apple under its policies. DAYFACTOR cannot directly issue an App Store refund.

8. Acceptable use

You may not:

  • use DAYFACTOR unlawfully or to harm another person;
  • attempt to bypass purchase, security or entitlement controls;
  • reverse engineer, copy, resell or redistribute the app except where applicable law expressly permits it;
  • interfere with the app, App Store services or connected systems;
  • misrepresent DAYFACTOR output as professional medical advice.

9. Intellectual property and license

DAYFACTOR, its design, code, text, visual identity and original content are owned by the operator or its licensors and protected by applicable intellectual property law. Subject to these terms, you receive a limited, personal, non-exclusive, non-transferable and revocable license to use the app on Apple devices you own or control as permitted by the App Store rules.

10. Third-party services and Apple terms

DAYFACTOR may rely on Apple services, Apple Health, StoreKit and RevenueCat. Their services can change, be unavailable or operate under separate terms. Apple is not responsible for DAYFACTOR's maintenance or support, except as required by applicable law. Your use is also subject to Apple's Licensed Application End User License Agreementand applicable App Store terms.

11. Availability and product changes

Features may evolve, be corrected, added, removed or temporarily unavailable. DAYFACTOR does not promise uninterrupted or error-free operation, permanent availability of any feature or compatibility with every device, iOS version or region. Material changes will be handled reasonably and in accordance with law.

12. Disclaimers

To the extent allowed by law, DAYFACTOR is provided “as is” and “as available.” No guarantee is made that goals, statistics, reminders, nutrition calculations, Apple Health information or insights will be complete, accurate or suitable for a particular purpose. Nothing in these terms excludes rights that cannot legally be excluded.

13. Limitation of liability

To the extent permitted by applicable law, the operator is not liable for indirect, incidental or consequential loss, loss of local data, missed reminders, reliance on wellness information, or third-party service failure. Liability that cannot be excluded remains limited only to the extent the law permits. This section does not limit liability for fraud, intentional misconduct, personal injury caused by negligence or mandatory consumer rights.

14. Suspension and termination

You may stop using DAYFACTOR at any time. Access may be restricted where reasonably necessary to prevent misuse, protect the product or comply with law. Subscription cancellation must still be completed through Apple. Sections that by their nature should survive termination—including intellectual property, disclaimers and liability limits—will survive.

15. Governing law

These terms are governed by Swedish law, without depriving consumers of mandatory protections in their country of residence. Disputes should first be raised through support so the parties can try to resolve them. You may also have rights to use applicable consumer dispute-resolution bodies or courts.

16. Changes and contact

These terms may be updated as the product or law changes. A revised effective date and appropriate notice will be provided for material changes. Contact support@dayfactor.app with questions.
